These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Seam — Carousel & Collage (“Seam”, “we”, “our”, “us”) governing your access to and use of the Seam iOS application (“App”) and associated website.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

1. License Grant and Eligibility

• License: Subject to your compliance with these Terms and the Apple App Store Terms of Service, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on compatible Apple iOS devices that you own or control.
• Age Requirement: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

2. User Content & Intellectual Property

• Your Content: You retain all intellectual property rights, ownership, and copyright in and to any photos, images, logos, text, or other media you import, design, or export using the App ("User Content").
• Responsibility: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to use and display any User Content incorporated into your designs.
• Local Processing: Because User Content is processed and stored locally on your device, Seam does not host, curate, or monitor your creative work.

3. Seam Intellectual Property

All rights, title, and interest in and to the App, including its software code, interface design, graphic icons, default templates, vector shape presets, sticker libraries, and brand assets, are the exclusive property of Seam and its licensors. You may not copy, modify, distribute, sell, or lease any part of our software or assets without our prior written consent.

4. In-App Purchases, Subscriptions & Ad-Gated Features

• Ad-Gated Feature Unlocks: We offer certain premium features (such as Apple Vision AI background removal, bokeh blur, sticker generation, video auto-scroll pan export, 9-point mesh gradients, curated aesthetics, and premium templates) that can be unlocked per session by voluntarily viewing rewarded video advertisements provided via Google AdMob.
• In-App Purchases / Subscriptions (if applicable): Optional subscriptions or one-time premium purchases are billed to your Apple ID account at confirmation of purchase.
• Apple Billing Terms: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period in your Apple ID Account Settings. All payments, renewals, and refunds are handled exclusively by Apple pursuant to Apple Media Services Terms.

5. Third-Party Services and Advertisements

The App integrates third-party tools, including Google AdMob for advertising and Google Firebase for diagnostic analytics. Your interactions with third-party advertisements or services are solely between you and the respective provider.

6. Acceptable Use and Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Attempt to bypass, disable, or circumvent any ad verification mechanisms, security features, or feature gating.
• Use the App to generate, publish, or distribute content that is unlawful, defamatory, infringing, or violates the privacy of others.
• Distribute viruses, worms, or malicious code through or in connection with the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL DEVICES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SEAM, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, MEDIA, OR PROFITS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $50 USD IF FREE).

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India, subject to mandatory local consumer protection statutes in your region.

10. Modifications to Terms

We reserve the right to revise or modify these Terms at any time. Changes become effective immediately upon posting to this website with an updated "Last Updated" date. Your continued use of the App following the posting of updated Terms constitutes your agreement to such changes.
